Terms of Service — Ovenette Bake House

Welcome to ovenettebakehouse.com, operated by Ovenette Bake House ("Ovenette," "we," "us"), a registered sole proprietorship in San Luis Obispo County, California, doing business as "Ovenette" and "Ovenette Bake House." By using this site or placing an order, you agree to these terms.

1. Cottage Food Operation

Ovenette is a California Cottage Food Operation, meaning our products are made in a home kitchen, not a commercial kitchen inspected in the same manner as a restaurant or retail bakery. Products may contain or be prepared in a space that handles wheat, eggs, milk, soy, peanuts, tree nuts, and other allergens. Please review ingredient and allergen information before ordering if you have food allergies or sensitivities.

2. Orders and Pickup

All orders are for pickup only at a location and time provided to you at checkout or by us directly; we do not publish our kitchen address publicly. You'll select a pickup date and time when ordering, and may include special instructions. Please arrive within your scheduled pickup window — significant delays or no-shows may affect order availability.

3. Accounts

You may check out as a guest or create an account. Creating an account lets you view order history, save payment methods, and receive order updates. You're responsible for keeping your login method (email or phone) secure and for all activity under your account.

4. Custom Orders

Custom cake and cupcake orders (for birthdays and special events) are governed by a separate Custom Order Agreement, which you'll review and accept as part of that ordering process. That agreement covers deposits, cancellation policies, and other custom-order-specific terms, and takes precedence over these general Terms for any conflict specific to a custom order.

5. Payment

Payments are processed securely through Stripe. Prices are shown in U.S. dollars and include applicable sales tax. Standard (non-custom) orders are charged at checkout.

6. Cancellations and Refunds

For standard (non-custom) orders, contact us as soon as possible if you need to cancel or change an order — because our ingredients are purchased and prepared close to pickup time, we may not be able to accommodate late changes or offer a refund for orders already in progress. Custom orders follow the cancellation terms in the separate Custom Order Agreement.

7. Text Message Communications

If you opt in, we'll send order-related text messages (confirmations, pickup-ready alerts) to the phone number you provide. Message and data rates may apply. Reply STOP to unsubscribe, HELP for help. See our Privacy Policy for more on how we handle your information.

8. Intellectual Property

The Ovenette name, logo, and site content are our property or used with permission. You may not copy, reproduce, or use our branding without our written permission.

9. Disclaimer and Limitation of Liability

Our products are handmade; color, texture, and decoration will closely match but may not be a pixel-perfect reproduction of any reference image. To the extent permitted by California law, our liability arising from any order is limited to the amount you paid for that order. We are not liable for indirect or consequential damages.

10. Changes to These Terms

We may update these terms from time to time. Continued use of the site after changes means you accept the updated terms.

11. Governing Law

These terms are governed by the laws of the State of California. Any dispute will be resolved in San Luis Obispo County, California.
